1) Polish authorities require a statement that the couple is legally free to marry. The US Embassy can issue a letter explaining that such evidence from the U.S. government is not available, which may be used to waive this requirement by the Polish court. Please contact American Citizen Services at 022 504 27 84 for this letter.

After you are married, your new US citizen spouse may file a Petition for Alien Relative (Form I-130) any working day, Monday through Friday, from 1:30 to 3:00 pm. A list of the documents required at the time of filing the I-130 may be found here. If the petition is approved, you will then apply for an immigrant visa. At the present time, the waiting period for an interview is approximately 3-4 weeks. Although you may have a valid tourist visa, you should be aware that if an immigration inspector comes to the conclusion that you are an intending immigrant, you could be refused admission at the port of entry and returned to Poland.

2) With regard to vaccinations, generally, U.S. immigration law requires certain categories of visa applicants to obtain vaccinations. During your medical exam, the doctor will determine whether you have had the required vaccinations and/or whether it is medically appropriate for you to do so. Certain waivers of the vaccination requirement may be available upon the doctor's recommendation.
